「朝廷を凌駕する」とは法的にいかなる意味なのか、という問いがあってしかるべきではないか。事実として一時的に反乱軍が勝利しただけならともかく、その力関係が後醍醐による倒幕まで百年以上継続するのであるから、新たな法秩序が作られたと考えるべきであろう。
